En este trabajo presentamos los resultados del análisis del uso argumentativo de expresiones condicionales por parte de tres comunidades de hablante inmigrantes en Chile, a saber, colombianos, peruanos y venezolanos. Ellos respondieron un dilema social, y sus respuestas fueron analizadas por medio de cuatro métodos específicos: 1) descripción de la bicondicionalidad encontrada, 2) caracterización del vínculo entre el uso de conectores argumentativos y el tipo de construcción condicional, 3) análisis del tipo de entorno argumentativo en el que la construcción condicionalidad (...) apareció y 4) caracterización del contexto bicondicional prominente en términos del énfasis en el consecuente y/o antecedente. El principal resultado de nuestro análisis cuatripartito es que se constata una tendencia homogénea entre las comunidades de hablantes en términos de una convergencia hacia la perfección condicional. Dicho de otra forma, las diferencias de nacionalidad de origen, género o edad no repercuten en el tipo de expresión condicional utilizada, siendo la orientación paradigmática del uso una construcción de perfección condicional. O presente artigo apresenta um recorte de uma pesquisa de trabalho de conclusão de curso, cujo objetivo foi analisar as especificidades de como ocorre a Educação de Jovens e Adultos – EJA – de mulheres que vivem em situação carcerária, bem como as contribuições e limitações do processo educacional para a ressignificação e reinserção na sociedade. Especificamente a pesquisa se propõe a compreender como ocorre a Educação de Jovens e Adultos no sistema penitenciário feminino; apontar as contribuições da EJA no (...) processo de escolarização e reinserção de mulheres que vivem em situação de cárcere; e identificar as dificuldades e limitações encontradas na promoção da aprendizagem escolar no sistema prisional feminino no Conjunto Penal Nilton Gonçalves em Vitória da Conquista–BA. Optamos por uma pesquisa exploratória, de caráter qualitativo na perspectiva de desenvolvermos um estudo de caso. A pesquisa aponta a necessidade de ser estabelecido um processo educacional que contribua para ressignificação e ressocialização da pessoa encarcerada, bem como programas com práticas sócio-educativas que são garantidos por lei, mas que na prática pouco acontecem. The acceptance or rejection of classmates is one of the most widely recognized determinants of wellbeing in childhood. This study analyses psychosocial adjustment and sociometric status in primary education pupils, and possible differences by gender. A cross-sectional survey was undertaken in Huelva. The surveyed schools were selected using a stratified random sampling technique with both public and private elementary schools. Sample was composed of 247 4th grade students. Data revealed gender differences in psychosocial adjustment, particularly in terms of prosocial behavior (...) in girls and behavioral problems in boys. Popular and rejected statuses presented opposing adjustment profiles, particularly in hyperactive symptoms and behavioral problems. When the sample was separated by gender, the differences between the types of status in emotional symptomatology and prosocial behavior disappeared. In addition, the differences between statuses were greater in boys, and were defined mainly by hyperactivity, whilst for girls these differences were more apparent in behavioral problems. (shrink)

Pagando por suas alforrias, batizando seus filhos, enterrando seus mortos. Além do trabalhado pesado ainda havia espaço para afetividade, vida sexual, desejos e vontades das mulheres que viviam no sul da capitania. E não faltavam acusações de sodomias, feitiçarias, seduções, bigamias. Este texto é fruto de um projeto de pesquisa em andamento que perscruta mulheres africanas no sul da Bahia e desdobra-se em duas partes de suas vidas no período colonial e imperial, tomando-as não só como objetos de pesquisa, mas (...) dando-lhes a condição de serem narradas como protagonistas apoiadas em vastas e inéditas fontes. Este artigo optou por trazê-las no período colonial. Quanto ao período aludido sobressaiu-se nas fontes dois aspectos: as pecadoras denunciadas estavam relacionadas ou às práticas de feitiçaria ou à vida sexual e afetiva destoante do que preconizava as leis cristãs, sobretudo nos Cadernos do Promotor. As fontes utilizadas foram os Cadernos do Promotor, as Correspondências trocadas entre autoridades e uma memória descritiva sobre ser mulher, ser africana e ser escravizada ou forra em diferentes discursos. Appellate Court Modifications Extraction consists of, given an Appellate Court decision, identifying the proposed modifications by the upper Court of the lower Court judge’s decision. In this work, we propose a system to extract Appellate Court Modifications for Portuguese. Information extraction for legal texts has been previously addressed using different techniques and for several languages. Our proposal differs from previous work in two ways: our corpus is composed of Brazilian Appellate Court decisions, in which we look for a set of (...) modifications provided by the Court; and to automatically extract the modifications, we use a traditional Machine Learning approach and a Deep Learning approach, both as alternative solutions and as a combined solution. We tackle the Appellate Court Modifications Extraction task, experimenting with a wide variety of methods. In order to train and evaluate the system, we have built the KauaneJunior corpus, using public data disclosed by the Appellate State Court of Rio de Janeiro jurisprudence database. Our best method, which is a Bidirectional Long Short-Term Memory network combined with Conditional Random Fields, obtained an \ score of 94.79%. (shrink)

Com este breve artigo, prendemos fazer um estudo sobre os Sodomitas “de cor” perseguidos pela Inquisição Portuguesa na Bahia do século XVII. Inicialmente, faz-se uma reflexão sobre a Sodomia, delito contra a fé católica, crime que estava sob a alçada do Tribunal do Santo Ofício e que fora praticado pelos negros escravizados e a partir dos documentos inquisitoriais, discorremos sobre a trajetória dos desviantes: o cativo lisboeta Jeronimo Soares, que fora acusado de sodomita e “alcoviteiro” e o mulato ator cômico (...) Bugio, denunciado por praticar sodomia, por fim, procuramos evidenciar as andanças, força, formas de repressão utilizadas contra esses sodomitas no contexto baiano, assim com a influência da religião – Igreja Católica – e as ferramentas de controle utilizadas para “convencer” a sociedade colonial a seguir o caminho correto da fé e da moral. As fontes utilizadas são os registros de depoimentos dos “hereges” e das testemunhas, produzidas pelo Santo Ofício, localizadas no Arquivo Nacional da Torre do Tombo : Sumário de culpa nº 12257 e Caderno do Promotor nº 29. Este artigo faz uma análise substancial acerca da concepção do direito em Gustav Radbruch, procurando destacar, dentre outros aspectos, a “injustiça extrema”. É peremptório afirmar que para o grande jurista alemão, a questão da obediência à lei não se resolve pela força, como afirma a tradição. A pergunta essencial não é por que obedecer à “lei injusta”, mas porque se apoia na “lei injusta”, obedecendo-a. Ora, tudo isto significa a rigor, que a positividade no direito se contenta com a validade (...) formal das normas jurídicas, quando todo o problema se situa numa esfera mais profunda, correspondente ao valor ético do direito. Inclusive, a ausência de justiça não aflige apenas o sistema jurídico, mas outros sistemas sociais apresentam injustiças gritantes. (shrink)

Introdução: A Educação Permanente (EP) tem relação entre ensino e as práticas de atenção, levando em consideração a gestão, o desenvolvimento institucional e o controle social. Objetivo: Identificar fatores envolvidos na adesão dos profissionais nos programas de formação oferecidos pelo Complexo Hospitalar do Estado de Minas Gerais. Metodologia: Questionário aplicado a colaboradores da saúde do Complexo Hospitalar, relacionado às características dos profissionais e ao programa de EP. Resultados: A maioria dos participantes não sabia o verdadeiro conceito de EP. Participam das (...) capacitações e da análise de eficácia e o cronograma das ações educativas é feito com a equipe. A prioridade foi por ações presenciais. Discussão: A presença de mais de um vínculo empregatício, filhos e carga horária extensa de trabalho contribuíram para a baixa adesão fora do ambiente de trabalho. Conclusão: Colaboradores desconhecem o significado real da EP. As ações educativas agregam no conhecimento e na melhoria da assistência. (shrink)

The concept of corporal image includes how own body, taking into account their constituent parts, as well as the feelings related the those characteristics. The entrance in academica life provokes alterations in the feeding behavior, and the exposition to the new social environment they can bring as consequence an increase in dissatisfaction. Objective: To investigate the satisfaction with the body image and eating behavior of academics at a university center. Methods: For data collection, the following instruments were used. The evaluation (...) was performed with anthropometric measurements, as size and weight measurements. In order to diagnose the nutritional status, the body mass index was used. In order to evaluate the study variables; we used the Body Checking questionnaires Questionnaire. Male Body Checking Questionnaire, Body Shape Questionnaire and EAT-26. Results: According to the Body Mass Index, the female gender had a higher rate of adequacy (70.4%), in relation to the masculine (58,9%). The EAT-26 questionnaire showed that 85% of male engineering students presented risk for Feeding Disorders, in relation to the female psychology (89.8%). Conclusion: In terms of feeding behavior, the women scored higher than men, which suggests a higher susceptibility to Feeding Disorders development in men. (shrink)

ABSTRACT This article aims to analyze the process of mutual understanding from the perspective of Discursive Neurolinguistics. As a methodology, a case study was carried out on a child with a linguistic profile of verbal restriction, which concerns the dimension of utterances involving words and their morphology. Data interpretation was based on the Bakhtinian perspective, which addresses ‘understanding’ as an active-responsive process and meaning as emerging from the relationship between utterances. The results showed that the interlocutors’ common ground allowed the (...) joint construction of meaning even in the face of verbal restrictions, and aspects such as nonverbal elements and the recognition of the child’s active-responsive role also favored mutual understanding. As a conclusion, the attention to different multimodal resources as legitimate modes of expression allows children with verbal restrictions to fulfill the role of “speakers” regardless of their modes of expression. O relato é resultado da reflexão dos conhecimentos produzidos interculturalmente no percurso do Curso de Magistério Indígena, Nível Médio da Secretaria de Educação do Estado da Bahia. Theta-burst stimulation is a modification of TMS with similar efficacy and shorter session duration. ObjectiveThe presence of two or more chronic diseases results in worse clinical outcomes than expected by a simple combination of diseases. This synergistic effect is expected to be higher when combined with some conditions, depending on the number and severity of diseases. Multimorbidity is a relatively new term, with the first fundamental definitions appearing in 2015. Studies usually define it as the presence of at least two chronic medical illnesses. However, little is known regarding the relationship between mental disorders and (...) other non-psychiatric chronic diseases. This review aims at investigating the association between some mental disorders and non-psychiatric diseases, and their pattern of association.MethodsWe performed a systematic approach to selecting papers that studied relationships between chronic conditions that included one mental disorder from 2015 to 2021. These were processed using Covidence, including quality assessment.ResultsThis resulted in the inclusion of 26 papers in this study. It was found that there are strong associations between depression, psychosis, and multimorbidity, but recent studies that evaluated patterns of association of diseases had heterogeneous results. Quality assessment of the papers generally revealed low quality among the included studies.ConclusionsThere is evidence of an association between depressive disorders, anxiety disorders, and psychosis with multimorbidity. Este artigo propõe-se a discutir a possibilidade de utilizar as tecnologias digitais online e as redes sociais como espaço de aprendizagem digital de uma maneira que favoreça a aprendizagem cooperativa entre os estudantes, alicerçado na Epistemologia Genética de Jean Piaget. Este estudo foi baseado em uma pesquisa-ação, nas aulas de Matemática, realizada com estudantes do ensino médio integrado em informática do IFRS – Campus Osório (RS), em 2011 e 2012-1. Os estudantes demonstraram apropriação deste espaço de aprendizagem digital, como o (...) Facebook, e apontaram que este potencializa a aprendizagem cooperativa no que tange à disciplina de Matemática, por ações colaborativas com a professora. (shrink)

En este trabajo se defiende la tesis de que el liberalismo de corte individualista ha sido insuficiente como modelo teórico político para realizar el ideal liberal de libertad individual y, sobre esa base, se argumenta que lo determinante a la hora de realizar el ideal de libertad individual es la relación entre cultura y libertad. El liberalismo, sin que por ello ignore que hay culturas, se enfoca decididamente en el individuo y en su libertad. El objetivo fue determinar la relación entre el uso de las TIC y la neuroeducación en el aprendizaje de los alumnos. La investigación fue de tipo cuantitativo con diseño correlacional descriptivo de corte transversal mediante un cuestionario virtual. La población de estudio fueron 367 estudiantes de la Universidad Central del Ecuador. Para la obtención de los resultados se utilizó el programa estadístico SPSS v.25. El coeficiente de correlación de Spearman dio un valor de 0.754, revelando que existe una correlación moderada (...) positiva entre ambas variables TIC y neuroeducación. Conclusión: El 50% de docentes aplican gamificación para estimular la memoria visual. (shrink)

Como objetivo se determinó la relación entre los factores motivacionales y el rendimiento académico. La investigación fue cuantitativa de diseño correlacional con corte transversal. La muestra fueron 315 estudiantes de en dos Facultades de la Universidad Central del Ecuador. Se aplicó un cuestionario de 27 preguntas con escala de Likert. Para los análisis estadísticos se utilizó el software SPSS V25. El resultado principal dio una correlación de Pearson de 0,827, siendo fuerte positiva entre las dos variables. Además, se analizó la (...) relación con las diferentes dimensiones de cada variable. En conclusión, la motivación mejora el rendimiento académico de los estudiantes. (shrink)

O presente artigo objetiva examinar o pensamento de Severino Boécio acerca da aporia dos termos universais e suas respectivas implicações nos séculos V e VI da era cristã. Tais pensamentos são postos por ele em seu Comentário à Isagoge de Porfírio, fazendo ligações com algumas das principais obras que contribuíram para com o assunto. Boécio acaba por aplicar os termos universais à pluralidade das coisas, demonstrando que podemos pensá-los num sentido singular, quando, por exemplo, os percebemos sensivelmente nas coisas individuais (...) do mundo. Destarte, buscaremos explicar brevemente, nas páginas subseqüentes, as premissas propostas por Severino Boécio àquele que foi um dos problemas mais marcantes da filosofia medieval: o problema dos universais. This article aims to examine the thought of Severinus Boethius about the standoff between the universal terms and their implications in the fifth and sixth centuries of the Cristian era. Such thoughts are put by him in his Commentary on Porphyry Isagoge, making connections with some of the major works that contributed towards it. Boethius eventually applies the universal terms to the plurality of things, demonstrating that we can think of them in a unique way, when, for example, we notice substantially the individual things of the world. Thus, we will try to explain briefly, in the subsequent pages, the assumptions proposed by Severinus Boethius to whom was one of the key problems of medieval philosophy: the problem of universals. O presente artigo se propõe a analisar a relação entre o Supremo Tribunal Federal e os media, e como as notícias jurídicas do Plenário da mais importante Corte do país são transmitidas pela TV Justiça, pelos canais comerciais, e pelos novos media. Ademais, busca-se explorar a influência dos novos media na democratização da informação referente ao Judiciário. Em termos metodológicos, será utilizada abordagem hipotética dedutiva, com base em pesquisa bibliográfica e documental. In this paper, we raise two points. First, any rights‐based theory should provide a method by which to guide reasoning in addressing conflicts of rights. The reason, we argue, is that these theories must provide guidance on what should be done. Second, this method must contain two key recommendations: (1) We should try to find a deliberative mechanism through which none of the rights is simply eliminated from the scene; (2) these rights may be balanced against each other to define (...) which right should prevail, but without considering non‐rights‐interests as if they were rights in the process. These recommendations instantiate two crucial principles that underlie our common intuitions on rights, namely, the principle that rights deserve equal respect and the principle that rights should be taken seriously. Kitcher has proposed an ideal-theory account—well-ordered science (WOS)— of the collective good that science’s research agenda should promote. Against criticism regarding WOS’s action-guidance, Kitcher has advised critics not to confuse substantive ideals and the ways to arrive at them, and he has defended WOS as a necessary and useful ideal for science policy. I provide a distinction between two types of ideal-theories that helps clarifying WOS’s elusive nature. I use this distinction to argue that the action-guidance problem that WOS faces (...) remains even under the aims/means distinction, because the WOS’s failure is more basic than critics have suggested. O presente artigo menciona pontos que já apresentei noutro texto sobre o tempo como espelho da alma, no entanto ele recebe o acréscimo de dois pontos que mudam a ênfase de minha interpretação prévia: (1) a citação a Josué e (2) a escolha de Deus creator ominum para exemplificar a relação, via tempo, entre ser humano, (...) Deus e o mundo. Mediante a análise textual do livro XI, a seguinte conclusão será encaminhada: embora Agostinho não recuse a existência do tempo como uma realidade independente das vivências humanas, ele privilegia outro aspecto do tempo, medular nas Confissões, a saber, a relação humana com o tempo em correspondência com a intenção da vontade pela qual a vida humana é governada. Em Agostinho, o tempo da vida se compromete com a ética, e reflete o modo como a vontade habita a vida. Tempo e alma, nas Confissões, são interdependentes a ponto de a experiência humana do tempo ser um espelhamento da vontade. (shrink)

Is it justified to hold that an agent S has a (moral) right to P if the duty-bearer is not specified? There is an intense ongoing debate on this question. There are two positions in the literature. On the one hand, O´Neill´s much-discussed account of rights holds that it is justified to say that an agent S has a right to P if and only if the duty-bearer is sufficiently determined – i.e. if and only if it is clear against (...) whom S may claim her right to P (O’Neill 1986, 1988, 1996, 2000, 2005, 2016). Call this, the ‘claimability condition’. On the other hand, interest-based theorists argue that it can be justified to say that an agent S has a right to P even if the duty-bearer is not sufficiently determined (Caney 2007; Griffin, 2008; Raz 1988; Tasioulas 2007; see also: Etinson, 2013; Ypi 2010). Who (if anyone) is correct in this fundamental discussion about the very nature of rights? In this paper, I provide an answer to this crucial question. Neither O´Neill nor interest-based theorists provide good reasons to justify their positions. However, I argue, the claimability condition is an existence condition of rights justified on the basis of their action-guiding character. The reason is that if the duty-bearer is not specified, the content of the right (its correlative obligation) does not sufficiently guide what the agent should do because it is indeterminate who is required to act (or refrain from acting). An argument is epistemically self-defeating when either the truth of an argument’s conclusion or belief in an argument’s conclusion defeats one’s justification to believe at least one of that argument’s premises. Some extant defenses of the evidentiary value of intuition have invoked considerations of epistemic self-defeat in their defense. I argue that there is one kind of argument against intuition, an unreliability argument, which, even if epistemically self-defeating, can still imply that we are not justified in thinking intuition has evidentiary (...) value. Intellectual property regimes necessarily create artificial scarcity leading to wastage, both by blocking follow-up research and hindering access to those who are only able to pay less then the actual retail price. After revising the traditional arguments to hinder access to people’s intellectual labour we will examine why we should be more open to allow free-riding of inventive efforts, especially in cases where innovators have not secured the widest access to the fruits of their research and failed to cooperate with (...) follow-up innovators. We will do so by questioning the voluntariness involved in consumption of objects of innovation, restating the positive social externalities that arise when wider access to the fruits of innovation is assured, and examining the eventual harms innovators face. It is well known that the formal system developed by Frege in Begriffsschrift is based upon the distinction between function and argument—as opposed to the traditional distinction between subject and predicate. Almost all of the modern commentaries on Frege's work suggest a semantic interpretation of this distinction, and identify it with the ontological structure of function and object, upon which Grundgesetze is based. Those commentaries agree that the system proposed by Frege in Begriffsschrift has some gaps, but it is taken (...) as an essentially correct formal system for second-order logic: the first one in the history of logic. However, there is strong textual evidence that such an interpretation should be rejected. This evidence shows that the nature of the distinction between function and argument is stated by Frege in a significantly different way: it applies only to expressions and not to entities. The formal system based on this distinction is tremendously flexible and is suitable for making explicit the logical structure of contents as well as of deductive chains. We put forward a new reconstruction of the function-argument scheme and the quantification theory in Begriffsschrift. After that, we discuss the usual semantic interpretation of Begriffsschrift and show its inconsistencies with a rigorous reading of the text. (shrink)

Food security brings a number of benefits to humanity from which nobody can be excluded and which can be simultaneously enjoyed by all. An economic understanding of the concept sees food security qualify as a global public good. However, there are four other ways of understanding a public good which are worthy of attention. A normative public good is a good from which nobody ought to be excluded. Alternatively, one might acknowledge the benevolent character of a public good. Others have (...) argued that public goods demand being public in the sense of being visible to all. Finally, it has also been argued that public goods are those goods which need joint action to be produced and maintained. This chapter discusses these five understandings of the public good in relation to food security and highlights the advantage of assessing policies from each of these perspectives. (shrink)

The debate about how neurotechnologies impact authenticity has focused on two inter-related dimensions: self-discovery and self-creation. In this paper, we develop a broader framework that includes the experimental and relational dimensions of authenticity, both understood as decisive for shaping one’s narrative identity. In our view, neurointerventions that alter someone’s personality traits will also impact her very own self-understanding across time. We argue that experimental authenticity only needs a minimum conception of narrative coherence of the self and that reversibility should remain (...) a key feature in the ethical assessment of neurotechnologies. The relational dimension of authenticity derives from the fact that a process of self-constitution is never a solitary business. The significant others act not just as subsequent judges of one’s life decisions, but as real co-authors of one’s self. We discuss relevant cases in which others are actively contributing to the meaning-making process, as to the direction one’s life is taking. We also claim that the experimental and the relational dimensions of authenticity should aim to correct each other. The relational dimension introduces socially approved standards as well as limitations to the array of available possibilities of self-fashioning or human enhancement. The experimental side enables us to avoid confusing one’s personal identity with a social and narrative construct that only bears the mark of social pressure and conformism. (shrink)

The mixture of political, social, cultural and economic environments in Latin America, together with the enormous diversity in climates, natural habitats and biological resources the continent offers, make the ethical assessment of agricultural policies extremely difficult. Yet the experience gained while addressing the contemporary challenges the region faces, such as rapid urbanization, loss of culinary and crop diversity, extreme inequality, disappearing farming styles, water and land grabs, malnutrition and the restoration of the rule of law and social peace, can be (...) of great value to other regions in similar latitudes, development processes and social problems. This chapter will provide a brief overview of these challenges from the perspective of a continent that is exposed to the consequences of extreme inequality in multiple dimensions and conclude by arguing for the need to have a continuous South-South dialogue on the challenges of establishing socially and environmentally sustainable food systems. I explain why, from the perspective of knowledge-centric anti-luck epistemology, objective act consequentialist theories of ethics imply skepticism about the moral status of our prospective actions and also tend to be self-defeating, undermining the justification of consequentialist theories themselves. For according to knowledge-centric anti-luck epistemology there are modal anti-luck demands on both knowledge and justification, and it turns out that our beliefs about the moral status of our prospective actions are almost never able to satisfy these demands if objective act (...) consequentialism is true. This kind of applied moral skepticism introduces problematic limits on our ability to use objective act consequentialism’s explanatory power as evidence for its truth. This is, in part, a product of higher-order defeat as I explain in the final section. There is, however, a silver lining for objective act consequentialists. For there is at least one type of objective act consequentialism, prior existence consequentialism, that is poised to avoid at least some of the epistemic problems discussed in this paper. (shrink)

The much-discussed “claimability objection” holds that it is unjustified to believe that all individuals have a human right to subsistence because the bearers of the correlative duties are not sufficiently determined. This argument is based on the so-called “claimability-condition”: S has a right to P if and only if the duty-bearer is sufficiently determined. Practice-based theorists defend the human right to subsistence by arguing that if we take the existing human rights practice seriously, there is no indeterminacy about the allocation (...) of duties. In this paper, I challenge this (apparently compelling) defense of the human right to subsistence with a dilemma. If the claimability condition is true, the practice-based defense fails to undermine the claimability objection because the duty-bearer is determined in some, but not all, cases. If practice-based theorists reject the claimability condition, they generate an account of human rights that is problematic from the practical perspective because it may contain duties that are unable to guide action. The distinction between propositional and doxastic justification has been of undisputed theoretical importance in a wide range of contemporary epistemological debates. Yet there are a host of intimately related issues that have rarely been discussed in connection with this distinction. For instance, the distinction not only applies to an individual’s beliefs, but also to group beliefs and to various other attitudes that both groups and individuals can take: credence, commitment, suspension, faith, and hope. Moreover, discussions of propositional and doxastic justification (...) have rarely focused on broader meta-epistemological issues, and yet meta-epistemological positions can have important implications for first-order views about this distinction. This volume addresses these and other issues by bringing together 16 essays that advance the state-of-the-art thinking on propositional and doxastic justification and explore how such thinking shapes and is shaped by a range of issues previously neglected in contemporary epistemology. The forfeiture thesis is posed as an independent thesis in moral philosophy according to which agents forfeit (or lose) rights if they perform certain act-types. According to many, this thesis plays a crucial role in the justification of (legal) punishment. In this paper, I argue that the forfeiture thesis is unnecessary – we can simply dismiss it without any substantive loss. Echoing an aspect of the specificationist approach to rights, the reason is that we may replace the forfeiture thesis with (...) an exception clause in the very content of the right not to be subjected to hard treatment: P has no right not to be subjected to hard treatment simpliciter, but a right not to be subjected to hard treatment unless P performs an act-type φ – e.g., murdering an innocent person. This alternative has substantive advantages over the forfeiture thesis, which, in turn, shows that the former cannot be reduced to the latter. (shrink)

The organizational account of biological functions interprets functions as contributions of a trait to the maintenance of the organization that, in turn, maintains the trait. As has been recently argued, however, the account seems unable to provide a unified grounding for both intra- and cross-generation functions, since the latter do not contribute to the maintenance of the same organization which produces them. To face this ‘ontological problem’, a splitting account has been proposed, according to which the two kinds of functions (...) require distinct organizational definitions. In this article, we propose a solution for the ontological problem, by arguing that intra- and cross-generation functions can be said to contribute in the same way to the maintenance of the biological organization, characterized in terms of organizational self-maintenance. As a consequence, we suggest maintaining a unified organizational account of biological functions. (shrink)
